1. Acceptance of Terms

By creating an account or using Tonic.fm, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the app.

2. Eligibility

You must be at least 13 years old to create an account. Tonic.fm complies with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13. If we become aware that a user is under 13, we will promptly delete their account and all associated data.

3. Description of Service

Tonic.fm is a personal music catalogue and journal that allows you to rate, tag, and organize music. It supports importing playlists from Spotify, Apple Music, and Tidal. Tonic.fm does not host, stream, or play music. All music metadata and cover art are retrieved from third-party APIs.

You own your data. We do not claim ownership over your catalogue, ratings, notes, or any content you create. You can export or delete your data at any time from Account Settings. See our Privacy Policy for details on how your data is handled.

7. Copyright & Intellectual Property

The app's code, design, and branding are owned by the developer. Music metadata and cover art are sourced from third-party APIs (iTunes, Tidal) and belong to their respective rights holders. No music is hosted, streamed, or reproduced by Tonic.fm.

8. DMCA Copyright Policy

Tonic.fm respects the intellectual property rights of others and expects users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we will respond to notices of alleged copyright infringement.

If you believe that content on Tonic.fm infringes your copyright, please submit a DMCA takedown notice containing:

DMCA notices should be sent to the developer via the GitHub repository or by email. We will investigate and take appropriate action, including removing or disabling access to the allegedly infringing material.

If you believe your material was removed in error, you may file a counter-notification under 17 U.S.C. § 512(g).

9. Third-Party Services

Tonic.fm integrates with Supabase (authentication/storage), iTunes Search API (album art), and Tidal API (playlist imports). Use of these services is subject to their own terms. Tonic.fm does not obtain music licenses from ASCAP, BMI, SESAC, or any other performing rights organization because it does not perform, stream, or reproduce music.

Tonic.fm is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation.

11. Limitation of Liability

To the maximum extent permitted by Texas and federal law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app.

12. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Travis County, Texas.

13. Termination

You may delete your account at any time from Account Settings. We reserve the right to suspend or terminate accounts that violate these terms.

14. Changes to Terms

We may update these terms. Material changes will require re-consent via the app. The version number is tracked in the app's code.
